Prerogativa regis, 17 Edw. 2, Stat. 1.--A. D. 1334.

CHAP. 11.  His prerogative in having the wreck of the sea.--Whales and sturgeons.

    See the charter to the proprietor, Sect. 4--and see the note on 3 Edw. 1, Ch. 4.  It is not considered
necessary that the prerogative respecting royal fish, &c. if it came to the state, should be retained.

CHAP. 7.  Executors shall have an action of trespass for a wrong done to their
testator.

    This statute has been practised under in the province and in the state, before the passage of the
testamentary law.  It is not inconsistent with that law, and therefore is not repealed by it; but inasmuch
as by the 5th section of the 8th chapter thereof, it is in substance re-enacted, it is considered
that the case is sufficiently provided for thereby.  This statute is mentioned in the letter from S.
Chase, which has been referred to.
