lected, or they may be collected by process before
a Justice of the Peace, or in any of the Courts of
the city of Baltimore having jurisdiction in such
cases ; and the said Mayor and City Council are
hereby authorized and empowered to appoint

 

watchmen or such police force as may be necessary
for the protection of their Water Works in the
city and County of Baltimore, and to impose fines
and penalties for interference with or injury to the
works or their appendages, to prevent the water
from being obstructed or contaminated, and to
prohibit all meddling or tampering with the Water
Works and their appurtenances ; said fines and
penalties shall be enforced as provided in this Ar-
ticle, Sections two hundred and twenty-nine to two
hundred and thirty-five inclusive.

Appoint
watchmen.

Sec. 2. And be it enacted, That this Act shall
take effect from the date of its passage.

Approved March 30, 1868.

CHAPTER 468.

AN ACT to make valid the official acts of certain
Constables appointed by the Mayor and City
Council of Baltimore, elected under the present
Constitution of the State of Maryland.

 

WHEREAS the present Mayor and City Council of
Baltimore, elected under the present Constitution
of the State of Maryland, did, in or about the
month of November, eighteen hundred and sixty-
seven, appoint certain Constables for the city of
Baltimore ; and whereas the Court of Appeals of
Maryland has since decided, in the case of William
P. Smith et al. vs. Robert A. Thursby, that the
said Mayor and City Council of Baltimore had not
the right at that time to make said appointments,
and that therefore said appointments were irregular
and illegal ; and whereas said Constables, prior to
