case one-half the above rates of toll shall be de-
manded and paid ; for every score o/ sheep, swine,
or neat cattle, for every space of ten miles in
length of the said road, the sum of fifteen cents
for sheep and swine, and neat cattle twenty-five
cents, and so in. proportion for any greater or
lesser distance, or for any greater or lesser num-
ber ; for every horse and rider, or led horse, mare,
mule or gelding, one and a half cents per mile.

 

Sec. 8. And be it enacted, That the Directors
of said Company shall have power to make and
adopt such by-laws, rules and regulations for the
direction and management of said Company as
may in their judgment be necessary for the pur-
poses of this incorporation, not inconsistent with
the provisions of this charter and the laws and
Constitution of this State, and the President and
Directors of said Company, or a majority of them,
shall constitute, appoint and employ such officers,
agents and servants for the construction, preserva-
tion and repair of said road, and for the receipt
and collection of tolls, and the transaction of all
other business of said Company, as in their judg-
ment may be necessary.

By-laws.

Sec. 9. And be it enacted, That if any person or
persons whatever, riding or driving anything
whatever, or leading the same, shall therewith
pass through any private gate or bar, or turn off
said road with the intention of avoiding the pay-
ment of toll or passing through such gate, all and
every person so offending shall for every such
offence forfeit and pay to the said President and
Directors a sum not exceeding twenty dollars, to
be sued for and recovered with costs of suit before
any Justice of the Peace in like manner as debts
of similar amounts may be sued for and recovered,
and if any toll-gatherer shall demand and know-
ingly receive any greater toll than he is authorized
to receive by this Act, he shall forfeit twenty dol-
lars for every such offence for the use of the county.

Penalty.

Sec. 10. And be it enacted, That if any person
or persons shall wilfully, by any means whatever,
injure, impair, or destroy any part of said road,
or any of its necessary works and buildings, or
place any obstructions on said road, or if any per-
son or persons shall effect or attempt to effect an
