CHAPTER 363.

AN ACT providing for the repairs of the Public
Roads of Montgomery County.

 

SECTION 1. Be it enacted by the General Assembly
Maryland, That the County Commissioners of
Montgomery County shall appoint two experienced
and competent persons in each election district;
every two years, who shall be taxpayers in said
county, at their first meeting next ensuing the
passage of this law, or as soon thereafter as prac-
ticable, to remain in office two years, who, in con-
junction with one of the County Commissioners,
shall constitute a Board of Road Commissioners,
a majority of whom shall have power to act, and
who shall have charge of the public roads in the
several election districts, and shall examine and
report to the County Commissioners on their con-
dition and the amount of money required for their
repairs.

Sec. 2. And be it enacted, That it shall be the
duty of the said Board of Commissioners to lay off
all the public roads in their respective election
districts into convenient sections, not exceeding
five miles in length, and draw specifications for
the same, numbering each road section, and pro-
portion and allot to each section such labor as
hereinafter provided for; and they are hereby au-
thorized and empowered, on the first Monday in
April, or as soon thereafter as practicable, to let
or farm out to the lowest responsible bidder or
bidders, the several road sections for repairs in
their respective districts, or any part thereof,
annually, requiring the contractor or contractors,
lessee or lessees, to give bond for the faithful per-
formance of their contracts, under proper penalties
and restrictions, to be approved by the County
Commissioners, by giving at least fifteen days'
notice of the time and place of letting said road
sections, in any newspaper published in the county,
or by written or printed notices posted at three or
more of the most public places in said district;
