general meetings of the stockholders may be called
by any number of the stockholders, not less than
five nor holding less than one-fourth of the whole
number of shares, to consider any general interest
of the said Company, and the said general meet-
ing, if representing more than one-half the whole
number of shares in said Company, shall have
power, by a majority of votes, to make, alter or
repeal, all or any of the by-laws, rules and regu-
lations of said managers.

 

Sec. 8. That the said Company are hereby in-
vested with all the rights and powers necessary
for the construction of a Turnpike Road from the
west side of the Georgetown turnpike, where it is
intersected by the public road leading from No-
lan's Ferry to Frederick, through Buckeystown
and Licksville to Nolan's Ferry, on the Potomac
River, provided the Company may use the bed of
the public road aforesaid, or so much thereof as
may be necessary.

Rights and
powers.

Sec. 11. That as soon as the President and Man-
agers of the said Company have finished three
miles of said road, they shall give notice to the
Governor of the State, who shall thereupon forth-
with nominate and appoint, three skillful and ju-
dicious persons to view and examine the same, and
report to him in writing, whether the said road is
so far executed in a good and workmanlike man-
ner, according to the true intent and meaning of
this Act, and if their reports shall be in the affir-
mative, then the Governor shall, by license under
his hand and the seal of the State, permit the said
President, Managers and Company to erect such
and so many gates upon and across the said road
as will be necessary and sufficient to collect the
tolls and duties hereinafter granted to said Com-
pany, from all persons traveling on the same, with
horses, cattle, wagons, carts and carriages, and so
in like manner, when the balance or remainder of
the said road shall be completed.

Sec. 13. That the said Company, having fin-
ished the said road, the same having been exam-
ined, approved and licensed in the manner afore-
said, it shall and may be lawful for them to appoint
such and so many toll gatherers as they shall deem
proper to collect and receive of, or from any person
