CHAPTER 334.
AN ACT supplementary and amendatory of an
Act passed at the present Session of the General
Assembly of Maryland, entitled "An Act to
amend the Charter of the Cumberland and
Pennsylvania Railroad Company, passed at
January Session, eighteen hundred and forty-
nine, Chapter four hundred and sixty-nine."

SECTION 1. Be it enacted by the General Assembly
of Maryland, That the first Section of the Act
passed at the present Session of this General As-
sembly, entitled "An Act to amend the Charter
of the Cumberland and Pennsylvania Railroad
Company," passed January Session, eighteen hun-
dred and forty-nine, Chapter four hundred and
sixty-nine, be and the same is hereby repealed,
and that in lieu and substitution thereof it shall
be, and is hereby enacted as follows : The said
Cumberland and Pennsylvania Railroad Company
is hereby authorized to charge for toll and trans-

portation of coal over its Railroad not exceeding
five cents per ton per mile when and where the
distance of such transportation shall not exceed a
distance of five miles ; and is authorized to charge
for toll and transportation of coal over its Rail-
road not exceeding four cents per ton per mile
when and where the distance of such transporta-
tion shall be more than five miles, and not exceed-
ing ten miles ; and is authorized to charge for
toll and transportation over its Railroad when and
where the distance shall exceed ten miles not ex-
ceeding three cents per ton per mile ; provided,
that the gross charge per ton per mile when and
where the distance shall exceed five miles, shall
not be less than the gross sum hereby allowed for
toll and transportation for a distance of five miles,
and that, except as to existing contracts hereto-
fore made by said Railroad Company, and only
for the period not yet expired of such contracts
respectively, and except also in so far as may be
otherwise provided in this Act, the charges for toll
and transportation over said Railroad shall be
uniform and equal at the same rates per ton per
