mile ; for every horse or mule and rider, and every
led or driven horse or mule, one and one-half cents
per mile.

By-laws.
|
Sec. 8. And be it enacted, That the Directors of
said Company shall have power to make and adopt
such by-laws, rules and regulations, for the direc-
tion and management of said Company, as may in
their judgment be necessary for the purposes of
their incorporation, not inconsistent with the pro-
visions of this charter and the laws and Consti-
tution of this State ; and the President and Direc-
tors of said Company, or a majority of them, shall
constitute, appoint and employ such officers,
agents and servants for the construction, preserva-
tion and repair of said road, and for the receipt
and collection of tolls, and the transaction of all
other business of said Company, as in their judg-
ment may be necessary.

Penalty.
|
Sec. 9. And be it enacted, That if any person
or persons whatever, riding or driving anything
whatever, or leading the same, shall therewith
pass through any private gate or bar, or turn off
said road with the intention of avoiding the pay-
ment of toll for passing through such gate, and all
and every person so offending shall for every such
offence, forfeit and pay to the said President and
Directors, a sum not exceeding twenty dollars, to
be sued for and recovered, with costs of suit, before
any Justice of the Peace, in like manner as debts
of similar amount may be sued for and recovered ;
and if any toll-gatherer shall demand and know-
ingly receive any greater toll than he is authorized
to receive by this Act, he shall forfeit ten dollars
for every such offence for the use of the county.

indicted.

Sec. 10. And be it enacted, That if any person
or persons shall wilfully, by any means whatsoever,
injure, impair or destroy any part of said road, or
any of its necessary works and buildings, or place
any obstructions on said road, or if any person or
persons shall effect or attempt to effect an entrance
through any toll-gate on said road by force, vio-
lence or intimidation, such person or persons so
offending shall be subject to an indictment in the
Circuit Court of the county, and upon conviction
of such offences shall be punished by fine and im-
prisonment in the discretion of the Court.
