take place, and in case of death, resignation, re-
fusal or neglect to act, or removal from the State
of any officer, his place shall be filled by the Board
of Directors until the next annual election ; pro-
vided, the removal from the State of any Director
may not operate to vacate his place should there
be a majority of the Directors still residing in the
State.

In force.

Sec. 4. And be it enacted, That this Act shall
take effect from the date of its passage ; provided,
however, that the present officers of the said Kent
County Railroad Company shall hold their respec-
tive offices and perform all the functions thereof,

and exercise all the powers thereof in the same
manner as if this Act had not been passed until
the second Monday of May, eighteen hundred and
sixty-eight, and until their successors shall be
elected.

CHAPTER 284.

 

AN ACT to authorize the Baltimore and Ohio
Railroad Company to lay a railroad track in
certain streets in the city of Baltimore, and to
make an appropriation for paying the expenses
thereof, on account of and for the interest of the
Tobacco Fund.

Lay track.

SECTION 1. Be it enacted by the General Assembly
of Maryland, That the Baltimore and Ohio Rail-
road Company be and they are hereby authorized
with the consent of the Mayor and City Council of
Baltimore, first had and obtained, to lay a single
railroad track connecting with the track at the
corner of Charles and Carnden streets in the city
of Baltimore, and thence down Charles street to
Conway street, and thence along Conway street to
Light street, said track to be subject as to its loca-
