ful for them to appoint such and so many toll-
gatherers as they shall think proper, to collect and
receive of and from all and every person using the
said road such tolls and rates as the President and
Directors may think just and expedient, not ex-
ceeding however the rates charged by the Balti-
more and Frederick Turnpike Company, under the
Act of eighteen hundred and four, Chapter fifty-
one, or the supplements thereto, and to stop any
persons riding, leading or driving any horses, cat-
tle, hogs, sheep or any kind of chaise, wagon,
sled, carriage, or other vehicle of pleasure or bur-

 

den from passing through the said gates until they
shall have paid the same ; provided, that this
Company shall not be authorized to charge any
tolls on any vehicle or horse passing over this road
for the purpose of going to or from a funeral.

Funerals.

Sec. 10. And be it enacted, That if the said Com-
pany after the said road is completed as aforesaid,
shall neglect to keep the same in good order for the
space of sixty days, the Circuit Court for Anne
Arundel or Baltimore Counties may in its discre-
tion fine the President of said Company a sum not
exceeding one hundred dollars, for the use of the
County Commissioners of said counties.

Sec. 11. And be it enacted, That if any person
or persons whomsoever riding or driving himself
or any animal or thing for which tolls are pre-
scribed by this Act shall pass through any private
gate, or bar, passage-way, or over ground with
the intent to defraud the said Company and avoid
the payment of the toll or duty for passing through
any of its gates or turnpike, such person or per-
sons in all or any of the ways or means so offend-
ing shall for every such offence respectively forfeit
and pay to said Company any sum not less than
ten dollars nor more than twenty dollars, to be

sued for and recovered with costs of suit before
any Justice of the Peace, in like manner as debts
of similar amount may be sued for and recovered,
and with the right of appeal as in such cases.

Penalty.

Sec. 12. And be it enacted, That nothing here-
inbefore contained shall be construed to prevent a
forfeiture of their charter, in case the provisions
of this Act shall not be complied with.
