above prescribed and authorized by this charter to
be charged, and to stop any persons riding, lead-
ing or driving any horses, cattle, hogs, sheep, or
any kind of chaise, cart, wagon, sled, carriage,
buggy or other vehicle of pleasure or burthen from
passing through the said gates until they shall
ave paid the same.

Fine.

Sec. 10. And be it enacted, That if any person or
persons whosoever, riding, driving or leading any
animal or thing for which tolls are prescribed by
this Act shall pass through any private gate or
bar passage-way, or other ground, with the intent
to defraud the said Company, and avoid the pay-
ment of the toll or duty for passing through any
of its gates or turnpike, such person or persons in
all or any of the ways or means so offending, shall
for every such offence, respectively, forfeit and pay
to said Company any sum not less than ten dol-
lars nor more than twenty dollars, to be sued for
and recovered with costs of suit before any Justice
of the Peace, in like manner as debts of a similar
amount may be sued for and recovered, and with
a right of appeal as in such cases.

May obstruct,

Sec. 11. And be it enacted, That this Company
during the construction of said road have the right
to close said road to travel, when in their judgment
such travel will work an injury to said road.

Examination.

Sec. 12. And be it enacted, That so soon as the
said Company shall have perfected the said road,
they shall give notice thereof to the Judges of the
Circuit Court for Carroll County, who shall there-
upon forthwith nominate and appoint three judi-
cious persons to view and examine the same, and
report to them in writing whether the said road is
so far executed in a masterly, workmanlike man-
ner, according to the intent and meaning of this
Act, and if their report shall be in the affirmative
then the said Judges shall by license under their

License.

hands and seals, permit and suffer the said Com-
pany to erect and place (in addition to the toll-
gate allowed to be placed upon said road on the
completion of the first two miles,) such and so
many other gates upon and across said road as will
be necessary and sufficient to collect the tolls and
duties grafted to said Company by this Act from
all persons using the same; and provided, that
