CHAPTER 97.
AN ACT to repeal Sections three, nine, sixteen,
seventeen and eighty-seven of Article seventy-
three of the Code of Public General Laws re-
lating to the Maryland Penitentiary, and to
substitute in lieu of Sections three, nine, sixteen,
seventeen and eighty-seven, the following :

substituted.

SECTION 1. Be it enacted by the General Assembly
of Maryland, That Sections three, nine, sixteen,
seventeen and eighty-seven of Article seventy-
three of the Code of Public General Laws relating
to the Maryland Penitentiary, be and the same
are hereby repealed, and that the following be
substituted for Sections three, nine, sixteen, seven-
teen and eighty-seven :

3. The Directors of the Maryland Penitentiary
shall annually appoint at their regular stated
meeting in the month of May a Warden for the
Penitentiary, who shall serve for one year or until
the stated meeting of the Board of Directors, to
be held in the month of May of the year succeeding
his election, or in the contingency, of the failure
or omission of the Board to make an appointment

May remove.

at the time aforesaid to serve until his successor
shall be chosen. He may be removed from office
at any stated or special meeting of the Board,
whenever in the judgment of the Directors the
public interest may require such removal, and in
the event of the office becoming vacant by re-
moval, death or resignation, the Directors afore-
said shall make a new appointment for the unex-
pired term of the late" incumbent.

Salary of
Warden,
|
9. The Warden shall receive a salary at the rate
of two thousand dollars per year, and shall be
allowed the occupancy of such parts of the front
buildings aS a dwelling as are not used for the
purposes of the Penitentiary, and all necessary
out-houses, yards and grounds not within the
walls of the prison proper. He shall also be al-
lowed such fuel as may be necessary for his private
use in the building aforesaid, but shall receive no
other pay, emoluments or perquisite for his ser-
vices,
