gatherers ; provided, that if the said President and
Directors of said Company shall not be able to agree
with the owner or owners of any such lands, then

Condemn,
|
it may and shall be lawful for the said President
and Directors to proceed to have such lands con-
demned, in the same way and manner provided for
by the tenth section of the original Act, to which
this Act is a supplement, in cases where the said
President and Directors are not able to agree with
the owner or owners of lands needed for the con-
struction of the said turnpike road.

Act repealed.
|
Sec. 5. And be it enacted, That so much of the
original Act of eighteen hundred and sixty-four,
Chapter ninety-six, to which this Act is a supple-
ment, as shall be found inconsistent with the pro-
visions of this Act, be and the same is hereby re-
pealed.

Sec. 6. And le if, enacted, That this Act shall
take effect from the date of its passage ; the Gen-

eral Assembly reserves the right to annul, alter or
amend this Act at pleasure.

CHAPTER 28.
AN ACT to change a part of the dividing line be-
tween the Third and Fourth Election Districts
of Baltimore County.
|
Preamble.
|
WHEREAS, Pursuant to an Act, passed January
fifteenth, eighteen hundred and thirty-nine, Chap-
ter nine, the County Commissioners of Baltimore
County did appoint Commissioners, who estab-
lished the Old Church Road, from what was known
as William Owings's Lower Mill (now Paititer's
Mill) to the Garrison Church, to be the dividing
line between the Third and Fourth Election Dis-
tricts of Baltimore County ; and whereas, said Old
Church Road having been vacated and closed and
a new road opened in lieu thereof, therefore,
