EXECUTIVE DEPARTMENT,

Annapolis, February 21, 1868.
Gentlemen of the Senate :

I transmit herewith a copy of a communication just re-
ceived from Hon. B. F. Wade, President pro tempore, of the
United States Senate, accompanying a Resolution of that
Body in reference to the case of the Honorable Philip F.
Thomas, United States Senator from this State.

UNITED STATES SENATE CHAMBER,

Washington, Feb. 20, 1868.

His Excellency, Thomas Swann,

Governor of the State of Maryland :

SIR:—In obedience to an order of the Senate, directing me
to inform you of its action in reference to the Honorable
Philip F. Thomas, claiming a seat in the Senate of the
United States, as a Senator from the State of Maryland, I
have the honor to transmit herewith its Resolution, passed
on the 19th of February, instant.

I have the honor to be, Sir,

Pro tempore.

IN THE SENATE OF THE UNITED STATES,

February 19, 1868.

Resolved, That Philip F. Thomas, having voluntarily
given aid, countenance and encouragement to persons en-
gaged in armed hostility to the United States, is not entitled
to take the oath of office as a Senator of the United States
from the State of Maryland, or to hold a seat in this Body as
such Senator ; and that the President pro tempore of the
Senate inform the Governor of the State of Maryland, of the
action of the Senate in the premises.
