compenastion for supporting such prisoner shall be paid within
ten days from the delivering of such statement and notice, the
said prisoner will be discharged from gaol.

 

SEC. 3, And be it enacted, That if any action shall be brought
against any sheriff or gaoler for the escape of any prisoner dis-
charged or permitted to go at large in pursuance of this act,
such sheriff or gaoler may plead the general issue, and give this
act and the special matter in evidence ; and unless the plaintiff
or plaintiffs on the trial of such issue shall prove the payment or
a tender made to the said sheriff or gaoler, of the amount of com-
pensation due to the sheriff in virtue of this act, and of the act
to which this is a supplement, for keeping and supporting such
prisoner at the time of discharging or permitting him to go at
large, the said plaintiff or plaintiffs in such action shall not be
entitled to recover.

DECEMBER, 1823.— CHAPTER 25.

AN ACT to authorize the several Levy Courts in this State to recover from
delinquent supervisors and other debtors, any sum of money not exceed-
ing fifty dollars, which may be due to their respective counties, as other
small debts are recoverable by individuals out of court.

General
issue.

Be it enacted, by the General Assembly of Maryland, That
the several levy courts in this state, may at any time hereafter
order their respective clerks to state accounts, with their seal of
office annexed thereto, between their respective counties, and
any supervisor or supervisors, his or their security or securities,
or other person or persons who now are or may hereafter
become indebted to such counties in a sum or sums less than
fifty dollars ; and that the same shall be recoverable by process
issued by justices of the peace, in the same manner as other
small debts are recoverable by individuals out of court, any law
to the contrary notwithstanding.

CHAPTER 62.

AN ACT to authorize the Levy Courts of the several counties of this state
to pay the funeral expenses of Paupers out of the Poor House of said
county.

Authority.

Be it enacted, by the General Assembly of Maryland, That it
shall and may be lawful for the levy courts of the several
counties of this state, to levy and assess on the assessable pro-
perty of said counties, except Baltimore county, such sum or
sums of money as shall be adequate to liquidate such accounts
as they shall find necessary for the payment of all the accounts
allowed by them for the funeral expenses of paupers,.out of the
poor house of said county.
