LAWS OF MARYLAND.— 1822.

 

be lawful for the chancellor or the county court by whom the
commission shall have been awarded, on the application by
petition in writing of any heir, representative, purchaser, or
other party interested, to appoint in the place of such deceased
commissioners the same number of other discreet and sensible
men, for the purpose of completing said trust, and every such
petition shall set forth the substance of the first application, the
issuing of the commission, the progress which the commission-
ers shall have made towards completing their trust, and the
decease of a majority of the commissioners,

SEC. 2. And be it enacted, That the register in chancery or
the clerk of the county court, as the case may be, shall there-
upon issue another commission directed to the surviving com-
missioner or commissioners appointed under the act to which
this is a supplement, and to the commissioners appointed by
virtue of this act, reciting in substance the facts set forth in
said petition, and authorizing and requiring the said commis-
sioners, or the major part of them, forthwith to proceed to the
completion of the said trust, and directing them to return the
said second commission together with a certificate of their pro-
ceedings annexed to the same with all convenient speed ; and
the said commissioners, upon receiving said second commis-
sion shall before a justice of the peace in and for the county
wherein they shall respectively reside, severally make oath or
affirmation, that they will well and faithfully perform the duties
required of them by the said second commission without favour,
partiality or prejudice, and according to the best of their judg-
ments and understanding; and that the said justice shall certify
the taking of such oath or affirmation, and annex his certificate
to the said second commission.
SEC. 3. And be it enacted, That the commissioners appointed
by virtue of this act, shall' have, and they are hereby vested
with the same power and authority to complete the aforesaid
trust, that would have been used or exercised by the commis-
sioners appointed by the first commission.

A SUPPLEMENT to the ACT,* entitled, an Act to repeal parts of the Acts of
Assembly therein mentioned.

SEC. 1. Be it enacted, by the General Assembly of Maryland,
That all fines hereafter to be imposed by magistrates upon per-
sons who profanely swear or curse in their presence, in virtue
of the provisions of the act of 1723, chapter 16, shall be placed
by them in the hands of the constable or constables of the
hundred wherein the said offenders may reside for collection,
and it shall be the duty of the said constable or constables to
