CHAPTER 162.

AN ACT to punish certain Breaches of Trust.

 

SEC. 1. Be it enacted, by the General Assembly of Maryland,
That if any president or director of any bank chartered by the
laws of this state, shall fraudulently embezzle, secrete, or make
way with, any money, goods, bill, bond, note, check, evidence
of debt, or other valuable security or effects, belonging to such
bank, every such offender, his adviser, procurer, aider or abet-
tor, shall be deemed guilty of felony, and on conviction thereof
shall be sentenced to imprisonment and labour in the peniten-
tiary, for not less th&n five years nor more than fifteen years.

SEC. 2. And be it enacted, That if any cashier, servant, agent
or clerk, or any person employed for the purpose or in the capa-
city of cashier, servant, agent or clerk, to any person or persons
whomsoever, of to any body corporate or politic, shall by virtue
of such employment, receive or take into his possession any
money, goods, bill, note, bond, check, evidence of debt, or other
valuable security or effects, for and in the name or on account
of his employer or employers, and shall fraudulently embezzle,
secrete, or make way with the same, or any part thereof, every
such offender shall be deemed guilty of having feloniously
stolen the same from his employer or employers, for whose use,
or in whose name or names, or on whose account, the same was
or were delivered to, or taken into the possession of such cashier,
servant, clerk, or other person employed, although such money,
goods, bill, bond, note, check, evidence of debt, or other valuable
security or effects, was or were no otherwise received into the
possession of such employer, than by the actual possession of
his or their cashier, servant or clerk, or other person so em-
ployed, and every such offender, his adviser, aider, procurer or
abettor, shall, on conviction thereof, be sentenced to imprison-
ment and labour in the penitentiary, for not less than five nor
more than fifteen years, in the discretion of the court.

SEC. 3. And be it enacted, That the act, entitled, ati act for
the punishment of offences committed against banks by the
officers thereof, passed at December session eighteen hundred
and nineteen, chapter one hundred and forty-five, be and the
same is hereby repealed.

CHAPTER 164.

AN Act incorporating into one the several Acts relating to Constables Fees.
Supplement, 1821, ch. 162.

SEC. 1. Be it enacted, by the General Assembly of Maryland,
That no constable, by reason or colour of his office, shall have,
receive, or take of any person or persons, directly or indirectly,
any greater fees which shall arise or become due by virtue of
