Qualifica-
tion.

that may be offered for inspection ; Provided, however, the
person so appointed shall first take the oath or affirmation of
office, as the case may be, now directed by law to be taken by
the inspectors ; and the said sick or disabled inspector, and his
securities, shall be answerable for all tobacco inspected and
passed by the person so appointed by him, in the same manner
as if he had personally officiated.

SEC. 3. And be it enacted, That whenever any of the said
warehouses shall require repairing or re-building, it shall be
the duty of the said inspectors to notify the governor of the
same, who shall thereupon appoint as many persons as he may
deem necessary, not exceeding three, to act as commissioners
in contracting for, and superintending the said necessary re-
pairs and re-building; and after the same shall have been com-

out of the treasury aforesaid, which sum or sums shall be paid
into the treasury by the inspectors aforesaid, to re-imbuise the
state for the amount thus expended in said repairs and re-
building.

SEC. 4. And be it enacted, That the provisions of this act,
and of the original act to which this is a supplement, shall not
be construed so as to relate or extend to any tobacco which
may have been in said warehouses, or any of them," and which
shall have been inspected prior to the first Monday in February
in the year eighteen hundred and thirty-nine, but all the reve-
nue which shall have accrued, or which may become due for
the same, shall be paid to the late inspectors thereof, to be by
them paid over and accounted for to the levy court of

SEC. 5. And be it enacted, That until the first day of April,
in the year eighteen hundred and forty, the charges for outage,
porterage and sealing to be paid by the purchaser or owner of
