It shall be the duty of justices of the peace whenever they commit any
|
 
|
person for want of bail, on charge for assault and battery, for keep-
|
 
|
ing a disorderly house, or for violation of the law regulating the
|
 
|
issuing of licenses, or any small offence punishable by fine and
|
 
|
imprisonment, to endorse on the commitment the names and place
|
 
|
of residence of the witnesses, and recognize them to appear before
|
 
|
the court on the next Saturday thereof, and it shall be the duty of
|
 
|
the warden to make entries on his docket thereof — 1839, ch. 241,
