SEC. 2. And be it enacted, That the justices of the several
magistrates' courts in Kent county are hereby required to re-
cognize the parties and the witnesses in the several cases of
assault and battery, depending before them at the time of the
passage of this act, to appear before Kent county court at their
next regular session thereafter, and file such recognizances
with the clerk of said court.

MONTGOMERY COUNTY.
AN ACT to provide for making and keeping an Index of the Judgments
that may hereafter be rendered in Montgomery County Court, or that
may be rendered by Magistrates' Courts or single Justices of the Peace,
where the same may be made Liens upon Land, by complying with the
law relating thereto. — 1839, ch. 93.

SEC. 1. Be. it enacted ', by the General Assembly of Maryland,
That from and after the passage of this act, it shall be the duty
of the clerk of Montgomery county court, to keep or make a
short record or index of all judgments that may hereafter be
rendered in Montgomery county court; also, all judgments
that may be rendered by the magistrates' courts or single jus-
tices of said county, that may be made liens upon land, by com-
plying with the law relating thereto.

SEC. 2. And be it further enacted, That the clerk shall be
allowed at the same rate as he is now allowed for recording
generally, which shall be taxed to the plaintiff, and collected
as all other fees are.

Be it enacted by the General Assembly of Maryland, That
all that part of the seventh section of the act to which this is a
supplement, which imposed a penalty or fine upon the clerk of
the levy court, and the clerk of the commissioners of the tax,
to be recovered by indictment in Montgomery county court, be
repealed, and the same is hereby repealed.

SEC. 1. Be it enacted, by the General Assembly of Maryland,
That all the dividends due from the bank stocks hitherto invested
as the free school fund of Montgomery county, and all other
moneys that have accrued or may hereafter accrue to said fund,
shall be paid by the treasurer of the western shore of Maryland
to the order of the commissioners for Montgomery county, and
