COUNTY COMMISSIONERS.

entitled to, for like services, and in case said clerk of Wash-
ington county court shall neglect or refuse to comply with any
of the provisions or requisitions contained in this act, when
called on by the said commissioners, or the clerk thereof, by
their order thereafter, he shall for every such neglect or refu-
sal, forfeit and pay the said commissioners for the use of the

said county, the sum of one hundred dollars, to be recovered
by indictment or action, in Washington county court.

Penalty.

SEC. 9. And be it enacted, That the commissioners for Wash-
ington county aforesaid, shall have for their use and under
their control, the same room in the court-house in Hagers-
town, which is now used by the commissioners of the tax of
Washington county, and they shall be entitled to receive into
their care and charge, all the books, record and papers of the
levy court, and all moneys, books of accounts, vouchers and
other papers in possession of the clerk or any other person,
acting under the said levy court, and also all papers, books of
accounts, vouchers and olhef papers, in the hands of the com-
missioners of the tax, when the commissioners shall be quali-
fied to act as herein before provided, and each of the said com-

missioners shall be entitled to receive two dollars per day, for
every day he shall necessarily attend to the duties of his office,
and twelve and a half cents for every mile over ten miles, for
necessary travelling from his usual residence to Hagerstown,
and returning therefrom, in attending to his duties as commis-
sioner.

SEC. 10. And be it enacted, That so much of any acts of
assembly as may be contrary to, or inconsistent with the provi-
sions of this act, be, and the same are hereby repealed.

Repeal.

SEC. 11. And be it enacted. That the said commissioners
shall and may at any time during each and every [and every]
year, make, complete and close their levy, any law to the con-
trary notwithstanding ; and that all suits, at law or in equity,
which may be pending at the passage of this act, by or against
the justices of the levy court of said county, shall be carried
on in like manner and have the same legal effect, either in
favour of or against the commissioners, [providing] for by this
act, as if such suit or suits had been instituted by or against
the said commissioners.

A SUPPLEMENT to the ACT, entitled, an Act to provide for electing
Commissioners for Washington County, and prescribing their powers
and duties.— 1830, ch. 75.

Levy; suits.

SEC. 1. Be it enacted, by the General Assembly of Maryland,
That from and after the passage of this act the commissioners
of Washington county, upon the petition of any six freeholders
in said county, describing sufficiently any road which they may
wish to have opened, straightened, altered, or shut up, be and
