ance of the several and respective duties hereby imposed,
which bond shall be recorded in the clerk's office of the
county court of said county, and a copy thereof, under the
seal of the said county court, shall be as sufficient evidence as
the original would be, if produced and proved, and the said
clerk when appointed, shall also take and subscribe the follow-
ing oath, or affirmation, as the case may be, to wit : I, A. B. do
swear, or affirm, that as clerk to the commissioners of Wash-
ington county, I will honestly and faithfully to the best of my
skill and judgment, execute the duties of said office, without
favour, affection or prejudice, so help me God ; which oath or
affirmation any one of said commissioners is hereby authorized
to administer, and the said clerk shall be subject to the same
penalties and forfeitures for non-performance or neglect of
official duty, as are prescribed by the existing laws, in relation
as well to the several matters and things which the clerk of
the said county court of said county, may be legally directed
and required to perform, under the authority of the levy court,
us likewise to those which appertain to the office of the present
clerk of the commissioners of the tax for said county.

Vacancy of
clerkship.

SEC. 6. And be it enacted, That in case of a vacancy occur-
ring in the office of clerk to the commissioners, as created by
this act, in consequence of death, resignation, removal or dis-
qualification, the same shall be supplied as soon thereafter as
may be practicable, in the manner prescribed and directed by
the preceding section of this act.

Compensa-

tion.

SEC. 7. And be it enacted, That the said clerk of the com-
missioners, to be appointed in virtue of this act as aforesaid,
[to] be entitled to receive as compensation for his services,
such sum annually as the commissioners may direct, not ex-
ceeding the sum of three hundred dollars, to be levied on the
assessable property of said county, collected and paid over as
the other county charges.

Records,
books, &c.

SEC. 8. And be it enacted, That upon the appointment of a
clerk to the commissioners as aforesaid, the clerk of Washing-
ton county court, shall upon demand of the said clerk to the
commissioners, by order of the said commissioners, forthwith
deliver over to the said clerk of the commissioners, all books,
accounts, papers and documents, belonging to, or in any man-
ner appertaining to the said levy court of said county, and shall
annually, on or before the second Monday of June, furnish to,
and lay before the said commissioners, all copies of such lists,
accounts, papers and documents, as may be useful and neces-
sary to the said commissioners in ascertaining the county
charges, and according to the directions which he may from
time to time receive from the said commissioners, for which
services he shall have and receive such fees, as by law he is
