legal effect, either in favour or against the commissioners of the
tax, or the levy court for Talbot county, provided for in this
act, as if such suit or suits bad been instituted by or against
said commissioners.

To be elect-
ed annually
by classes.
|
SEC. 12. And be it enacted. That after the commissioners
shall be organized, it shall be the duty of said commissioners
to divide themselves as nearly equal as may be, into three
classes, which classes shall be by lot, No. one, two and three,
the first class shall go out the first year, and be replaced by a
new election, at the next annual election, the second class at the
second year, and the third class at the third year, and so to be
annually replaced by annual elections forever thereafter, any
law to the contrary notwithstanding.

row money.

SEC. 13. And be it enacted, That the commissioners afore-
said shall have power and authority to borrow money, in anti-
cipation of the money to be raised by county levies, from any
individuals or corporate bodies who may be willing to lend the
same, for the purpose of paying witnesses summoned on behalf
of the state of Maryland, and which money so borrowed shall
be paid, with interest thereon, not exceeding six per cent, per
annum, by a draft or drafts on the collector for Talbot county.

Payment of
witnesses.
|
SEC. 14. And be it enacted, That no witnesses summoned
in behalf of the state shall be paid, but such as are entitled to
be paid by law, and who shall receive a certificate from the
clerk of Talbot county to that effect.

Clerk to
give certifi-
cate.

SEC. 15. And be it enacted, That it shall be the duty of the
clerk of the county court for Talbot county, upon the applica-
tion of such witness or witnesses entitled to receive payment
from Talbot county, to give such witness or witnesses such
certificate as aforesaid.

Loans, how
to be paid.
|
SEC. 16. And be it enacted, That all loans made upon the
above authority shall be paid out of the first money which may
come into the hands of the aforesaid collector not otherwise
appropriated.

Repeal.
|
SEC. 17. And be it enacted, That from and after the first
Monday of October, eighteen hundred and thirty-one, all laws
contrary or inconsistent with this act, shall cease to operate.
