SCHOOLS.

school money which the law makes it the duty of the said court
to draw for, receive and pay over, may for every such oflence,
and at any time within two years after the committing of the
same, be indicted therefor, in the county court of said county ;
and if upon trial he shall be found guilty of misconduct as afore-
said, he shall suffer for each and every offence as aforesaid, a
fine of one hundred dollars, to be collected from him by the
sheriff of saitl county who shall forthwith pay over the sum so
collected, to the orphans court of said county for the benefit of
the school funds of said county ; and moreover the person that
may be found guilty as aforesaid, shall in addition to the said
fine, be compelled by the said county court to forfeit and pay

amount of damages sustained by the said school funds, or by
any school or teacher, or person or persons, in consequence of

out delay, one-half thereof to the said orphans court for the
benefit of the school fund aforesaid, and the other half thereof
to, and for the use of the party or parties injured, or among
such parties according to a just apportionment to be made to

jury as aforesaid.

SEC. 12. And be it enacted, That any person, who, whilst
being or acting as a school commissioner in any district in said
county, shall abuse the trust reposed in such commissioner by
law, or be in any manner guilty of a violation of his duty as
such, shall forfeit and pay for each and every oflence, the sum
of twenty dollars for the benefit of the school funds of said
county, which said fine shall be recovered by indictment, in
the same manner as mentioned in the preceding section, and
be collected and paid over in the like manner, wholly to the
orphans court.

distributed in said county, the apportionment whereof, is not
specifically, or otherwise particularly, herein before provided
