missioners ; and the person so appointed shall before be enters

Bond.

upon the duties of his office, execute a bond to the state of
Maryland, to be approved by the said commissioners, in the
penalty of one thousand dollars, conditioned for the true and
faithful performance of the several and respective duties hereby
imposed, which bond shall be recorded in the clerk's office of
the county court of said county, and a copy thereof, under the
seal of said court, shall be as sufficient evidence as the original ;
and the said clerk, when appointed, shall also take and sub-
scribe the following oath or affirmation, (as the case may be) to

Oath.

wit: 'I, A. B. do swear or affirm, that, as clerk to the commis-
sioners of Cecil county, I will honestly and faithfully, to the
best of my skill and judgment, execute the duties of said office,
without favour, affection, or partiality, so help me God ;' which
oath or affirmation any one of the said eomrnissioneis is hereby
authorized to administer ; and the said clerk shall be subject to
the same penalties and forfeitures, for non-performance or
neglect of official duty, as are prescribed by the existing laws
of this state, in relation to the clerk of the former commis-
sioners.

Vacancy of
clerkship.

SEC. 6. And be it enacted, That in case of a vacancy occur-
ring in the office of clerk to the commissioners as created by
this act, in consequence of death, resignation, removal or dis-
qualification, the same shall be supplied as soon thereafter as
may be practicable, in the manner prescribed and directed by
the preceding section of this act.

Clerk's
compensa-
tion.

SEC. 7. And be it enacted, That the said clerk of the com-
missioners, to be appointed in virtue of this act as aforesaid,
shall be entitled to receive as compensation for his services,
such sum annually as the said commissioners may direct, not
exceeding the sum of three hundred dollars, to be levied on
the assessable property of said county, collected and paid over
as the other county charges are.

SEC. 8. And be it enacted. That upon the appointment of a
clerk to the commissioners, to be appointed by virtue of this
act, the clerk of the former commissioners shall, upon demand
of the aforesaid clerk, by order of said eomrnissioneis, forth-
with deliver over to the said clerk of the commissioners to be
appointed by this act, all the books, accounts, papers and docu-
ments, belonging or in any manner appertaining to the said
former commissioners, and in case the said clerk shall neglect
or refuse to comply with any of the provisions or requisitions
contained in this act, when called on by the said commissioners
or the clerk thereof by their order, he shall, for every such
