the respective portions of the proceeds of the surplus revenue
apportioned to said counties, by equal division of the one-half
of the proceeds of the said surplus revenue into twenty-one
equal parts; and as the white population of each of said coun-
ties is not known, the treasurer is fuither authorized and re-

quired, any law to the contrary notwithstanding, to invest from
time to time, as a joint fund, that portion being one-half of the
proceeds of the said surplus revenue apportioned to said three
counties according to their white population, and the interest
accruing on said investments in such stocks or public securi-
ties as he may deem most safe and lucrative, until after the
promulgation of the census of eighteen hundred and forty, when

the fund thus invested, or which under this act may be in-
vested, shall be distributed among the three said counties in a
ratio proportioned to the white population of each of the said
counties respectively, according to the census of eighteen hun-
dred and forty ; said proceeds after apportionment as aforesaid
to be paid as herein provided to the commissioners of Baltimore
county, to the commissioners of Carroll county, and to the levy
court of Frederick county, or to their orders, to be applied by
them according to the several laws on the subject.
SCHOOLS.
1816, ch. 256, ante page 654, creates the fund, which has been enlarged
from the tax imposed on banks, incorporated since that date.
1820, ch. 38, and 1823, ch. 13, relate to its distribution. They are
merged (or have performed their duties) in 1828, ch. 185.

Disposition
of proceeds.

SEC. I. Be it enacted, by the General Assembly of Maryland,
That the moiety of the school fund which Baltimore county,
exclusive of the city of Baltimore, is annually entitled to by
law, shall hereafter be paid by the treasurer for the western
shore of this state, to the commissioners of Baltimore county,
in trust, to be applied proportionably in the several election
districts of Baltimore county, in aid of the education of orphan
and other poor children, in establishing free schools in each of
the said districts.

SEC. 2. And be it enacted, That Theodore Anderson and
Nathaniel H. Ellicott, for the first election district of Baltimore
county ; John Crook and John T. Randall, for the second dis-
trict ; Elias Brown and Peter Little, for the third district;
John Gorsuch and William Jatnison, for the fourth district;
John Patlerson and John Sumwalt, for the fifth district ; Fre-
derick Hitter and William Houch, for the sixth district;
Richard Frisby and Thomas Johnson, for the seventh district;
Oeorge Harry man and John S. Webster, for the eighth district;
