powers, and be subject to the same penalties and forfeitures,
and responsible for escapes, in the same manner as the sheriffs
of* the respective counties are subject to in relation to prisoners
committed to their custody, and shall perform such other duties
as may be required of him by said visitors.

Warden's
fees;
appeal.

SEC. 6. And be it enacted, That the warden for the time
being shall be entitled to receive and collect in his own name,
but for the use of the visitors aforesaid, the same jail fees as
have heretofore been allowed by law to the sheriff of Baltimore
county, and in case of any dispute between the warden and
any prisoner, or the owner of any slave, or master of any
apprentice, who shall have been committed to his custody, in
relation to the amount of fees demanded by the warden from
any prisoner, or owner of any slave, or master of any appren-
tice as aforesaid, which shall be the subject of a contest before
a justice of the peace in Baltimore city, either party against
whom judgment shall be given, may appeal to Baltimore city
court, although the amount in dispute shall be under twenty
shillings.

Assistants.

SEC.7. And be it enacted, That the said visitors shall pre-
scribe the number and duties of the assistants who may be
necessary to be employed by the said warden, of whom he
shall have the appointment and removal, subject to the approval
of the board.

Warden's
bond and
oath.

SEC. 8. And be it enacted, That before the said warden shall
enter upon the duties of his said office, he shall give bond to
the state in the penalty of ten thousand dollars, with at least
two securities to be approved by the visitors, conditioned for
the faithful performance of his duty as warden, and for the
safe keeping of all such persons as shall be committed by legal
authority, to the jail of Baltimore county, which bond shall be
filed and recorded in Baltimore city court, and an office copy
under the seal of said court, shall be as good and lawful evi-
dence in the several courts of the state, as the original bond
would be if produced and proved ; and the said warden shall
also take and subscribe an oath, or affirmation, that he will
duly and faithfully execute the duties and trusts, and exercise
the powers committed to and vested in him as warden of the
jail of Baltimore city and county.

Receiving
prisoners.

SEC. 9. And be it enacted, That all commitments of pri-
soners to the jail of Baltimore county, whether on civil or crimi-
nal process, shall be directed to the warden of said jail, whose
duty it shall be to receive the prisoners from the officers having
them in charge.

Conduct
prisoners*

Sue. 10. And be it enacted, That the said warden be obliged
to conduct all prisoners in his custody, to and from the courts,
when the said courts shall direct him so to do.
