COUNTY COMMISSIONERS.

SEC. 2. Merged in 1838, ch. 201, sec. 1.

 

SEC. 3. And be it enacted, That the commissioners elected
or appointed as aforesaid, and their successors, shall be and they
are hereby constituted a body politic and corporate, by the name,
style and title, of The Commissioners of Baltimore County,
and by that name shall have continued and perpetual succes-
sion, and be capable in law of suing and being sued, of making
and using a corporate seal, and of altering the same, of taking,
holding, selling and conveying, all kinds of estates, property
and effects, and of doing all such acts as shall be necessary to
the exercise of all powers which are or shall be Tested in them
by this act, or by any other act of assembly, as fully and ef-
fectually as corporate bodies may or can lawfully and right-
fully do.

SEC. 4. And be it enacted, That when and as Soon as the
commissioners to be elected or appointed as aforesaid, shall
have taken and subscribed the oath or affirmation herein before
described, all the powers, rights and privileges, lawfully exer-
cised by, and all property, estate and effects, vested in the jus-
tices of the levy court of Baltimore county, so far as regards the
said county without the limits of the city of Baltimore, shall
be transferred to, and vested in, the commissioners for Balti-
more county, who or any two of them, shall thereafter exercise
all the said powers, rights and privileges, and shall perform all
the duties required to be performed by the said justices of the
levy court for Baltimore county, and no appointment of justices
of the levy court for Baltimore cotinty, shall thereafter be made:
and all the powers lawfully exercised by or vested in the com-
missioners of the tax for Baltimore county, and all the duties
required by law to be performed by them, shall be vested in
and exercised and performed by the said commissioners for
Baltimore county, after they shall have become qualified as
aforesaid.

SEC. 5. And be it enacted, That after the election and qua-
lification of the said commissioners of Baltimore county, the
mayor and city council of Baltimore shall provide for making
all such appointments, assessing and levying all such taxes,
and performing all such duties within the city of Baltimore, in
every matter regarding the said city, and the property therein,
as the levy court of Baltimore county are now accustomed and
authorized to do.

SEC. 6. And be it enacted, That the commissioners of Bal-
timore county shall appoint a treasurer of the said cotinty, who
shall give bond to the state of Maryland, in the penal sum of
ten thousand dollars, with at least two sureties to be approved
of by the said commissioners, with condition that he will faith-
fully and honestly perform the duties of treasurer of Baltimore
county, to the best of his ability, and pay over and apply all
