Collect
fines.
|
SEC. 13. And be it enacted, That the commanding officer of
each of said divisions, shall on or before the first day of June
next, and from time to time thereafter, as may be necessary,
appoint some suitable person to collect all fines imposed on the
officers) non-commissioned officers, musicians or privates of
said division, under the provisions of the act of eighteen hun-
dred and twenty- three, chapter one hundred and eighty-eight,
or of the supplements thereto, or under the provisions of this
act, which said collector before entering upon the duties of his

office, shall be required to give bond with security, to the state
of Maryland, in such sum as the commanding officer of the
division shall require, conditioned for the faithful performance
of the duties of collector of fines of said division, and it shall
be the duty of all officers of the division to whom returns are
made by any courts, within ten days after receiving lists of

copy of said lists of fines in the hands of the said division col-
lector, to be by him collected as herein after provided, and to
take his receipt for said list or a duplicate of the same, and the

said collector shall account for the moneys collected by him,
and pay over the same, when thereunto required, to the divi-

and under such other regulations as may have been established

money not exceeding fifty dollars, in the discretion of such
court martial as the case may require.

SEC. 14. And be it enacted, That upon the recommendation
of the major-generals respectively, there shall be commissioned
in each of the aforesaid divisions, a division paymaster with the
rank of major, and that all fines collected in either of the said

, divisions, shall be paid over by the collector to the division
paymaster, who before he enters upon the duties of his office,

shall be required to give bond with security to the state of
Maryland, in such sum as the commanding officer of the divi-
sion shall require for the faithful performance of his duties as
paymaster, that is to say, for the safe keeping of all moneys
paid into his hands by the collector, and for the keeping and re-
turning a true and just account of the same to the commanding
officer of the division, when thereunto required, also for the
paying over the whole or such parts of said moneys as may be
drawn for by him for repairs of arms, expenses of music and
other incidental expenses, also for the paying over any surplus
or balance in his hands, when thereunto required by the com-
