MILITIA.

regiment to which he belongs in the penal stim of two thou-
sand dollars, conditioned that he shall when required to do so,
submit to the commanding officer of his regiment a full and fair
statement of his accounts as paymaster aforesaid, and pay over
all balances remaining in his hands when demanded by his
successor, and in all things faithfully discharge the duties of
his office.

SEC. 63. And be it enacted, That all money hereby directed
to be paid into the hands of the paymaster of each regiment
shall be appropriated and applied by the commanding officer of
said regiment to the purposes of providing music for the several
parades prescribed by this act, and of the proper and safe keep-
ing of the arms and accoutrements, and of defraying such other
necessary expenses as the said officer shall deem requisite for
his regiment, and if at any time there should be such surplus
funds as in the opinion of said officer will uniform his regiment,
the same shall be done under his direction and superinten-
dence, and no money shall be drawn from the pay master of any
regiment except by a written order from the commanding officer
thereof, who shall always state the purpose for which it is
done; and if any officer shall neglect or refuse to comply with
any of the provisions of this section as required of him, he shall
be fined a sum not exceeding fifty dollars, in the discretion of
such court martial as the case may require.

SEC. 64. And be it enacted, That it shall be the duty of the
commanding officer of each regiment between the first and
thirteenth days of December, in each year, to call together by a
written or printed notice the field, staff and commanding
officers of the companies of his regiment at some convenient
place within the limits of said city, and then and there exhibit
to them a statement shewing the fines collected, the amount,
object and date of all disbursements, and the returns of the per-
son or persons appointed to collect the fines for the current year,
and when made, together with the returns of the several courts
of appeal held for the trial of the appeals of absentees from the
parades as established by this act for his regiment; and the
said statement shall also shew the fines incurred previous to
the current year as aforesaid, and still unpaid, as well as those
collected after the expiration of the year in which they were
