MILITIA,
more as aforesaid ; such officer or other person acting as afore-

said, shall be liable each and every of them to a fine of twenty
dollars, for each and every offence to be recovered before any
justice of the peace as small debts are now by law recovered,
one-half of said penalty to belong to the informer, and the
other half to the state, any law, custom or usage to the con-
trary notwithstanding.

AN ACT for the better regulation of the Militia of the City of Baltimore.

Revived by 1835, ch 295, so far as not inconsistent with that act.

SEC. 1. Be it enacted, by the General Assembly of Maryland,
That all able-bodied white male citizens between eighteen and
forty-five years of age, residents of the city of Baltimore, except
the vice-president of the United States, the officers judicial and
executive of the government of the United States, the members
of both houses of congress and their respective officers, the
members of the executive council and their clerks, the chancel-
lor, the judges of the county courts and clerks of those courts,
the judges of the city court and the clerk of that court, the
register in chancery, the register of wills, the registers of the
land office of the eastern and western shore, the clerks of the
courts of appeals, the members of the legislature of the state
and their clerks whilst in session, the professors and masters of
all colleges and public schools, school masters and practising
physicians, all custom house officers with their clerks, all post
officers and stage drivers who are employed in the care and con-
veyance of the mail of the post office of the United Slates, all
ferrymen employed at any ferry on the post road, all inspectors
of exports, all pilots, all mariners actually employed in the sea
services of any citizen or merchant within the United States,
all mariners actually engaged in the coasting trade from one
state to another, the treasurers of the eastern and western shore
and auditor, the officers employed in the penitentiary, and also
all ministers of the gospel regularly ordained, licensed or re-
cognized by any religious society, shall be liable to militia duty
or such regulations as are prescribed by the provisions of this
act.

SEC. 2. And be it enacted. That the said citizens shall be
and are hereby formed into a division to be called the third
division, and to be commanded by a major-general, who shall
be entitled to the usual staff officers.

SEC. 3 And be it enacted, That all such part of the said
city as lies east of a line drawn from the north side of the basin
and extending north along the middle of Calvert street to the
limits thereof, shall be divided into two equal parts as nearly
as practicable ; and each of said divisions shall be laid off into
