weighing less than sixteen ounces as aforesaid, the same butter
shall be taken and seized by the clerk of the market, and sold
for the use of Baltimore town.

No goods
to be sold

SEC. 5. Be it further enacted, That no person or persons shall
bring any goods or merchandise of any kind into the market-
square to sell before the hour of twelve o'clock ; and any per-
son acting herein contrary to this law, shall forfeit for every
offence committed, the sum of three pounds current money, to
be recovered as aforesaid.

SEC. 6. And be it enacted, That the clerk of the said markets
shall have full power and authority to seize by distress any meat
upon any ? tall in the Baltimore market-houses, if the butcher
owning such stall shall not pay the rent due thereon ; and the
said clerk is also hereby appointed to collect all fines and for-
feitures incurred under this law, and account for the same to
the commissioners of Baltimore town, for the use of said town.

AN ACT relating the to Baltimore Markets — 1835, ch 297.

Preamble

WHEREAS, it has been represented to this general assembly,
by the memorial of sundry citizens of this state, that the mayor
and city council of Baltimore, have passed an ordinance im-
posing a tax of twelve and a half cents, upon each and every
person who attend the Baltimore markets, with produce or arti-
cles of any description from the county, to vend in said mar-
kets, without regard to the value of the produce or articles, so
offered for sale as aforesaid, And whereas, the said tax is deemed
to be unequal, unjust and oppressive ; therefore,

SEC. 1. Be it enacted, by the General Assembly of Maryland,
That from and after the passage of this act, that no charge, tax,
fee or fees shall be set, rated or levied upon any person, oi the
property of any person who shall attend any of the Baltimore
markets, with any articles or produce from the country, to vend
in said markets oi their own growth, produce or manufactuie,
or as the agent of the grower, producer or manufacturers of the

same; Provided, such person or agent, be not a resident of
the city of Baltimore, unless such person oi persons shall
occupy some place or stand, in some one of the market-houses
erected by the city of Baltimore.

Liability of

SEC. 2. And be it enacteoj, That if any clerk of the market,
or any other person or officer appointed by or under the autho-
rity of the mayor and city council of Baltimore, shall at any
time hereafter demand, receive, or collect, or attempt to demand,
receive or collect any tax or other charges, from any person or
persons attending the Baltimore markets as herein before pro-
vided or which may hereafter be provided, who shall be stand-
ing in the open streets, and who do not occupy any place or
stand in some one of the market-houses in the city of Balti-
