AN ACT to vest certain powers in the Mayor and City Council of Balti-

more.— 1838, ch. 414.
|
|
Be it enacted, by the General Assembly of Maryland, That
the mayor and city council of Baltimore, be, and they are
|

hereby authorized to regulate by ordinance, the compensation

clerk, crier,
&c.

of the clerk, crier and bailiffs of Baltimore city-court, and to
|
|
provide for the application of the fees and perquisites to which
|
|
they are now entitled by law.

|
AN ACT relating to the City of Baltimore, and to certain Officers and

SEC. 1. Be it enacted, by the General Assembly of Maryland,
|

the city of Baltimore, that the corporation thereof shall have
|
|
power, whenever it may deem the same necessary, to compel
|
|
individuals, companies or bodies politic, owning property bind-
|
|
ing on Jones' Falls, within the limits of the city, to wall up
|
|
such property so far as the said property may bind on the Falls,
|
|
in such manner as the corporation may by ordinance direct.
|
|
SEC. 2. And be it enacted, That whenever the board of health
|

shall certify in writing to the mayor, that it is necessary for the
|

any street, lane or alley, on low or made ground, the mayor
|
|
shall issue his order to the city commissioners, who shall there-
|
|
upon call on the several property holders on such street, lane or
|
|
alley, so to be re-graded, and procure from them their assent in
|
|
writing to such alteration ; and if any property holder shall re-
|
|
fuse to permit the same to be graded, and should require
|
|
damages therefor, and if such property holder cannot agree
|
|
with said commissioners as to the amount of damages which he,
|
|
she or they ought to have, or there should be any legal dis-
|
|
ability on the part of these owning property on such street, lane
|
|
or alley, then the corporation shall proceed to ascertain the
|
|
damages in the same manner as is provided for the purchasing
|
|
of property in the tenth section of an act of assembly relating to
|
|
the city of Baltimore, passed at December session, eighteen hun-
|
|
dred and seventeen, chapter one hundred and forty-eight, for
|
|
opening and widening Jones' Falls.
|
|
SEC. 3. And be it enacted. That when the damages so as-

sessed or agreed upon, shall be paid by the corporation of Balti-
|
|
more to the persons so assessed and legally entitled to receive
|
|
the same, then the said corporation may proceed to re-grade and
|
|
pave the said street, lane or alley.
SEC. 4. And be it enacted, That the various acts of assem-
|
