PUBLIC ROADS.

SEC. 13. And be it enacted^ That the justices aforesaid may

same are payable by law to the said justices, and in case of

 

neglect or refusal in the said collector to settle and pay the same,

 

the said justices shall and they are hereby authorized, directed

 

and required, within two months thereafter, to issue an execu-

 

tion against the said collector or collectors, out of the county

 

court, for the sum of money so due from the said collector or

 

collectors, and shall have all the legal benefits and privileges

 

usually attending executions issued in behalf of the state of

 

Maryland ; and the said justices of the levy court shall also

 

liquidate and settle the accounts of all the supervisors within

 

their county annually at their levy courts; and the said justices

 

shall keep a fair record of all (heir proceedings relative to the

 

public roads.

 

SEC. 14. And be it enacted, That if any person or persons

upon, any of the said roads, or on any part or parts thereof, or

out down, destroy or injure, any of the bridges, causeways,

 

boundaries, marks or directions, therein or thereon, such person

 

or persons, being thereof convicted in the county court, shall be

 

fined at the discretion of the court for each and every such of-

 

fence, in any sum not exceeding fifty pounds, according to the

 

nature and degree of the offence; and all fines imposed in such

 

cases shall be appropriated to the purpose of repairing such

 

damages, and improving the roads in the county where the

 

offence is committed, and shall be paid to, and accounted for,

 

by the supervisor of the district wherein such damages shall be

 

sustained.

 

SEC. 15. WHEREAS the money to be raised under this act will

the public roads in said county, be, and he is hereby authorized

 

and directed, to summon or warn every free able bodied male

 

person, and also the master or mistress of any male servant,

 

above the age of sixteen years, in his district, to assist in repair-

 

ing the public roads in said district, and every person who shall

 

refuse or neglect, shall forfeit the sum of ten shillings current

 

money ; and every master or mistress as aforesaid, who shall

 

refuse or neglect to send all his or her male servants of the age

 

aforesaid, shall forfeit for each person the sum of ten shillings

 

current money; Provided nevertheless, that it shall and may be

 

lawful for every person who shall be summoned or warned

 

under this act, and for every master or mistress of servants as

 

aforesaid, in lieu of working on the public roads as aforesaid, to

 

pay to the supervisor of the said district! the sum of three shil-
