and if such non-commissioned officer or private, shall appear

without such musket or firelock, in serviceable order, which
shall appear to be the fault of said non-commissioned officer or
private, he shall forfeit one dollar for every such neglect ; and
the said fines shall be collected and paid over by the proper
sheriff, as other fines are directed to be, by this act.

SEC. 46. And be it enacted, That any arsenal which has here-
tofore been provided, and is now used by any uniformed militia
corps, may and shall be continued, in the discretion of said
corps, and the expenses, when certified to the governor and
council as reasonable and correct, and by them approved, shall
be a charge on the funds derived from fines, forfeitures, and
penalties, collected from said corps, and paid over to the trea-
surer of the western shore ; and shall be paid therefrom by
said treasurer upon the order of the governor and council, to
the paymaster of such corps, or to his order.

SEC. 47. And be it enacted, That before any paymaster shall
act as such, he shall give bond and security to the state of
Maryland, to the satisfaction of the field officers of the regi-
ment, extra battalion, or squadron, to which he belongs, in the
penal sum of one thousand dollars, conditioned that the officers
of the regiment, extra battalion, or squadron, will semi-annually
submit to the adjutant-general and the field officers of his regi-
ment, battalion, or squadron, a full and fair statement of his
accounts as paymaster as aforesaid ; and pay over all the
balances remaining in his hands, when demanded, by his suc-
cessor in office, or by the persons authorized to claim and re-
ceive the same; and in all things faithfully to discharge the
duties of his office.

SEC. 48. And be it enacted, That if any person shall sell or
buy, unless by the authority of the state, any of the arms or
accoutrements belonging to the state, or give or receive the
same, in pledge, barter, or as a gift, knowing the same to be
public property, or shall injure or destroy such arms or accou-
trements, such person shall, for every such offence, forfeit and
pay twenty dollars; and if such arms and accoutrements, shall,
by any of the means aforesaid, be rendered useless or become
lost, such person shall also forfeit and pay the full value thereof,
as fixed by the state for arms and accoutrements destroyed or
lost; and such forfeitures shall be recovered at the instance of
any commissioned officer, and be collected and be paid over by
the sheriff of the proper county, to the treasurer of the western
shore.

SEC. 49. And be it enacted, That whenever any of the public
arms or accoutrements shall be found in the possession of any
person except as authorized by this act, or any law of this
state, the same may be demanded by any commissioned officer;
