by this act ; and that it shall be the duty of every commissioned
officer to arm himself, as shall be prescribed by the commander-
in-chief of the militia of this state.

SEC. 41. And be if enacted, That each extra battalion or
squadron, shall have the same staff officers appointed, commis-
sioned, and attached thereto, as are attached to a regiment.

&c.

SEC. 42. And be it enacted, That the state and regimental
colours shall be provided by the field officers, and drums, fifes,
bugles, and trumpets, by the commissioned officers of compa-
nies, contributing in the proportion of the pay to which they
would be entitled, if in actual service ; but the governor and
council may distribute any drums, fifes, bugles, and trumpets,
belonging to this state, among the uniform or draughted militia
thereof, when, and as they shall deem expedient, taking receipts
from the commanding officers, for those that may be delivered
to them, respectively, in which the signer shall obligate to re-
turn the same when demanded, or pay the value thereof to the
state, which value shall be specified in such receipt.

SEC. 43. And be it enacted. That if any bystander shall inter-
rupt, molest, or insult any officer or soldier, while on duty, at
any time required by this act, or by the laws of any company,
the commanding officer of the company, at the time of such
offence, may cause the offender to be confined for the day, and

SEC. 44. And be it enacted, That no officer, non-commis-
sioned officer, or private, of the militia, in his attendance at,
going to, or returning from muster, shall be subject to arrest for
any civil matter, nor shall his military equipments be subject to
distress, attachment, or execution for debt.

SEC. 45. And be it enacted, That if any non-commissioned
officer, or private, who has provided himself with a musket or
firelock, or who has received one, the property of the slate,
shall appear in the ranks, at any meeting for inspection or drill,
ordered by this act, or the by-laws of the company of which he
