CHAPTER 276.

 

A SUPPLEMENT to an ACT, entitled, an Act for the protection of Oysters,
in the waters of the Eastern Shore of this State, passed at December
session, eighteen hundred and thirty-one, chapter two hundred and
forty-nine.

Be it enacted, by the General Assembly of Maryland, That
in all cases where fines and forfeitures may have been, or shall
hereafter be collected, under the provisions of the act, to which
this is a supplement ; it shall be the duty of the officer, so

other officers appointed by law, or hereafter to be appointed, to

SEC. 2. And be it enacted. That wherever the sheriff of any
county, shall have summoned his posse comitatus, with the in-
tention to proceed to the capture and arrest of any boats or
vessels, which may be engaged in taking oysters, in violation of
the provisons of the act, to which this is a supplement, he shall
have power and authority to seize upon, and take possession of
any vessel or steamboat, in his bailiwick, which he may find it

necessary to employ for such purpose ; Provided always, that
in case any detention, damage or injury, may be sustained by
any vessel or steamboat, so taken and employed by the sheriff,
and his posse, or in consequence thereof, the owner or owners
thereof shall be entitled to receive from the state, full indemnity
for the same, and also compensation and indemnity for the use
of, and detention of such vessel or steamboat.

Repeal.

SEC. 3. And be it enacted, That any thing contained in the
act to which this is a supplement, inconsistent with or repugnant
to the provisions of this act, be and the same is hereby repealed.
