aforesaid, shall forfeit fifty dollars for every person he shall
neglect so to remove, to be recoverable in the county court of
his county, by action of debt or indictment.
SEC. 2. And be it enacted, That nothing herein contained
shall be construed to repeal any part of the act to which this is
a supplement.

CHAPTER 152.
A SUPPLEMENT to the ACT, entitled, an Act to make valid certain Pro-
ceedings, passed at December session, eighteen hundred and twenty-six,
chapter ninety-nine.

 

Be it enacted, by the General Assembly of Maryland, That
the rights, privileges, exemptions, and protection, granted to the
several banks in this state, by the act to which this is a supple-
ment, shall be, and they and each of them are hereby extended
and granted to all other corporate bodies, and to all citizens and
residents of this state.

CHAPTER 155.
A SUPPLEMENT to an ACT, entitled, an Act declaring the Power of the
Governor in certain Criminal cases, passed at November session, seven-
teen hundred and ninety-five, chapter eighty -two.

 

Be it enacted, by the General Assembly of Maryland, That
no nolle prosequi shall hereafter be granted by the governor, but
on condition, that the costs of prosecution, which may have
accrued in the particular case, shall be paid by the person or
persons in whose behalf the nolle prosequi is granted.

CHAPTER 157.

AN ACT relating to certain Trespasses upon Real Estate.

 

SEC. 1. Be it enacted, by the General Assembly of Maryland,
That from and after the first day of May next, it shall and may
be lawful for any person aggrieved by the trespass upon his in-
closures, of any horned or black cattle, hogs or sheep, in the
possession or care of any person without the jurisdiction of this
state, to impound the same, and have the damages sustained
by reason of such trespass, valued on oath, by two disinterested
citizens of his county, and at the expiration of ten days, inclu-

sive of the day he impounds the same and the day of sale, pro-
ceed to make sale thereof at public auction to the highest
bidder, for cash, and after deducting from the proceeds of such
sale, the amount of damages valued to him, and a reasonable
compensation for feeding the same while in pound, he shall
pay over the residue, when demanded, to the legal owner of
said property so impounded and sold, or his agent.

party aggrieved, before making sale as aforesaid, to advertise
