CHAPTER 53.
A SUPPLEMENT to the ACT,* entitled, 'an Act to amend and reduce into
one system the laws to direct Descents.'

SEC. 1, Be. it enacted, by the General Assembly of Maryland,
That in any and all cases, under the act entitled, 'an act to di-
rect descents,' passed at November session, seventeen hundred
and eighty-six, and under the act to amend and reduce into one
system the laws to direct descents, passed at December session,
eighteen hundred and twenty, chapter one hundred and ninety-
one, where one of the heirs or persons entitled to take a real
estate has, or shall have made his election to take the same at
the valuation of the commissioners, and pay the other heirs
their proportionable share in money, or where all of the heirs
have, or shall have refused to take the estate at the valuation,
and the same has or shall have been sold by order of the court,
and no deed has been given for the premises to the heirs, or the
person so electing, or to the purchaser and all of the commis-
sioners, or a majority of them, have or shall have died, removed
out of this state, or otherwise become unable to execute a deed
under the commission, election, or order, as aforesaid, to the
person entitled thereto, the proper court or chancellor, as the
case may be, upon the application of such heir, or person enti-
tled ; and having made his election or a purchaser as aforesaid,
their heirs and devisees or assignees, or any person or persons
claiming under them, and being satisfied from all of the facts
and circumstances of the case, that the valuation or purchase
money has been paid, shall and may appoint one or more com-

missioners, who shall by said appointment have the power to
execute a deed for the premises to the party entitled thereto, as
the case may be, his heirs and assigns, which deed shall be as
good and valid to all intents and purposes as if the same had
been executed by the commissioners originally appointed in the
proceedings.

 

CHAPTER 50.
AN ACT to repeal an Act, entitled, 'an Act for the encouragement of an
Iron Manufacture within this Province.'

Repeal.

Be it enacted, by the General Assembly of Maryland, That
the act passed on the sixth day of June, in the year seventeen
hundred and nineteen, entitled, 'an act for the encouragement
of an iron manufacture within this province,' be and the same
is hereby repealed and annulled.
