and taken upon himself the execution thereof;
and whereas the said C. D. hath at the request
of the said A. B. actually paid to him the said
A. B. the whole legacy of
                                (the receipt of which the
said A. B. doth hereby acknowledge) although
there may be cause to apprehend a deficiency of
assets for payment of debts and other legacies.
The condition therefore of this obligation is
such, that if such deficiency shall actually and
bona fide happen, the said A. B. his executors
or administrators, shall, after request in that
behalf to him or them made, refund and pay
back unto him the said C. D. his executors or
administrators, his or their rateable part or
share of such deficiency, then this obligation to
be void, otherwise of force.
