for their control, discipline, armament and equip-
ment, as may be constitutional and necessary,
which rules and regulations shall, so far as prac-
ticable, conform to the laws and regulations gov-
erning the organizing of the United States volun-
teer forces, their discipline, equipment, armament
and officers, and which rules and regulations shall
have the force of law. |
Militia to con-
fast of. |
2. The militia of this State shall consist of all
able bodied male citizens of this State, between
the ages of eighteen and forty-five years, and not
exempt by the laws of the United States (except-
ing, however, the Lieutenant Governor, the Sec-
retary of the State, the Comptroller, the Treasu-
rer, and all persons whose religions opinions and
conscientious scruples forbid them to bear arms,
who shall produce to the proper authority proof
that they are so conscientious.) |
To be divided. |
3. The militia shall be divided into two classes,
the first class, or the active militia, shall be styled
" The Maryland National Guard," and shall con-
sist of the volunteer militia forces, and such as
may be drafted into such forces, as hereinafter pro-
vided; and in case of war, invasion, insurrection
or riots, or the reasonable apprehension of such,
the first class shall be first called into service, un-
less the Governor, as Commander-in-Chief shall
otherwise direct, and the first division of the Na-
tional Guard shall be formed within the city of
Baltimore; the second class or the Reserve Militia,
shall be called out, either in whole or in part, only
when the public safety, from the causes aforesaid,
shall bo so imminently endangered as to require,
in the opinion of the Commander-in-Chief, a larger
force than the National Guard can immediately
supply. |
In case of
War. |
4. In case of war, rebellion, insurrection or threat-
ened invasion of this or any neighboring State, the
Commander-in-Chief is hereby authorized to order
out, for actual service, either by calling for volun-
teers, by draft or otherwise, as many of the militia as
the exigency may in his judgment require; and
the Commander-in-Chief is hereby vested with the
full power and authority to fill up the National
Guard by draft, in case of such actual service, and |
