CHAPTER 337.

AN ACT to repeal article sixty-three Code of
Public General Laws, relating to Militia, and
sections six hundred and fifty-two to seven hun-
dred and seventy, both inclusive, of article four,
Code of Public Local Laws relating to Militia,
in the City of Baltimore, and to re-enact said
article sixty-three with amendments.

22,1867.

WHEREAS, doubt exist as to the validity and
constitutionality of chapter two hundred and
eighty-four of the laws of the State of Maryland,
of eighteen hundred and sixty-four, entitled an
Act to provide 'for the organization and discipline
of the Militia in as much as section seventeen, of
article three of the Constitution then in existence
was disregarded or violated, by professing to re-
peal laws by reference to title and section only;
therefore,

Preamble.

SECTION 1. Be it enacted by the General Assembly
of Maryland, That article sixty-three of the Code
of Public General Laws, relating to the Militia,
and sections from six hundred and fifty-two to
seven hundred and seventy, both inclusive, of arti-
cle four of the Code of Public Local Laws relating
to Militia in the city of Baltimore, be and they are
hereby repealed.

pealed.

Sec. 2. And be it enacted, That article sixty-three
of the Code of Public General Laws be and the
same is hereby amended and re-enacted, so as to
read as follows:

Article amen-
ded,

The Governor, as Commander-in-Chief, shall by
and with the advise and consent of the Senate, ap-
point one Inspector-General at a salary of five
thousand dollars per annum, who shall, under
rules and regulations to be prescribed by the Gov-
ernor as commander-ill-chief, as soon as practica-
ble, after his appointment and qualification, en-
roll and organize the militia of this State into
companies, batteries, squadrons, battalions, regi-
ments, brigades and divisions, and by general and
special orders to make such rules and regulations
