624 LAWS OF MARYLAND.

Presidency, a President shall be elected by the
Directors to serve until the next election by the
stockholders.

Discretion-
ary powers.

Sec. 8. And be it enacted. That the President
and Directors, or a majority of them, shall lay
out the turnpike over the bed of the present road
connecting the two towns, unless in their opinion
the best interests of the road require either an
entire or partial change of route.

Assessment of
damages.

Sec. 9. And be it enacted, That in case the
said Board of Directors shall not be able to agree
with the owner or owners of any land over or
through which lands the said road may be made,
it shall be lawful for said company to cause any
Justice of the Peace of Washington county to
issue his warrant to the Sheriff of said county
directing him to summon twenty impartial jurors
to meet on said land on a day to be therein named
to assess the damages sustained by said owner or
owners, by reason of said road passing through
such land, which inquisition shall be returned to
the Clerk's office, and either party shall have the
right to appeal to the Circuit Court of said county,
from the verdict or finding of said jury-within
sixty days from the date of said verdict.

.Limitation.

Sec. 10. And be it enacted, That said company
shall cause said road to be completed within five
years from the passage of said Act, otherwise the
right of said stockholders to revert to the State of
Maryland.

Width of
road.

Sec. 11. And be it enacted, That width of said
road shall not be less than thirty-three feet, with
a graded bed upon the same of not less than sev-
enteen feet in width, ten feet of which to be cov-
ered not less than ten inches in depth with stone
not more than three inches in any diameter.

Tolls.

Sec. 12. And be it enacted, That the said com-
pany shall have the right to erect one toll-gate,
and they are hereby authorized to appoint a toll-
gatherer, whose duty it shall be to receive of and
from all and every person or persons using said
road, the tolls and rates hereinafter mentioned,
and to stop any person riding, leading or driving
any horse, cattle, sheep, hogs, wagon, cart, car-
riage, sleigh, coach, or any other carriage of
