they may cause subscriptions to be received, giving
notice as aforesaid.

Authority to
lay off and con-
struct road,

Sec. 11. And be it enacted. That the President
and Directors shall have the power to lay off and
construct a Rail Road not exceeding one hundred
feet in width with one or more sets of tracks from
Frederick City, Maryland, thence by the shortest
and most practicable route in a north-eastern di-
rection through Frederick and Carroll counties to
the Maryland and Pennsylvania line, in the direc-
tion of Littlestown in the State of Pennsylvania,
up the Valley of the Monocacy, connecting with or
crossing the Western Maryland Rail Road or the
line or lines of survey of said Road and thence by
the most eligible and practicable route to the
Pennsylvania and Maryland line in the direction
of Littlestown, and for the purpose of laying off
and constructing said road or roads, they shall
have all powers and privileges and be subject to
all the requirements and liabilities hereinafter
described, and they may take and adopt the route
or routes which to them may seem most suitable
and proper.

Sec. 12. And be it enacted, That the President
and Directors of said Company shall be and they
are hereby invested with all the rights and powers
necessary for the repairs, of said Rail Road, may
enter upon, use and excavate any land which may
be needed for said Rail Road, may build bridges,
fix scales and weights, lay rails and may take and
use any earth, timber, gravel, stone or other ma-
terial which may be needed in order to the proper
construction of said Road.

May borrow
money.

Sec. 13. And be it enacted, That for the purpose
of constructing and equipping said Rail Road, the
Company is hereby authorized to borrow money to
any amount not exceeding one million of dollars,
the interest thereon to bepaid semi-annually, and
to issue coupon bonds therefor in sums not less
than one hundred dollars, and to secure the pay-
ment of said bonds and their interest by executing
and delivering to such trustees as they shall select
a mortgage or mortgages of all or any part of said
property.
