the peace, and generally to maintain the quiet and
good order of the town; arrest all offenders and
take them before the Mayor for trial, and execute
the process of said Mayor, and to have authority
to summon the posse comitatus in the enforcement
of the ordinances of the town, and the execution
of his duty.

Sec. 3. Be it enacted. That each of said police
shall receive not less than fifteen dollars and not
more than twenty-five dollars per month for their
services, to be paid by the Mayor and Council, the
same to be paid out of the funds of the corpora-
tion to be levied upon the taxable property of said
town, and in addition thereto, such police shall
receive the fees of their office.

Pay of Police
Officers.

Sec. 4. Be it enacted. That the police, regular
and special, to be appointed under the provisions
of this Act shall be liable to presentment and in-
dictment in the Circuit Court for Washington
County for any official misconduct as such police,
and on conviction shall be fined not less than
twenty dollars nor more than one hundred dollars;
the one-half to be paid to the informer (if there
bean informer) who shall be a competent witness,
and the other half to the State, and if no informer
the whole to the State, or be imprisoned in the
county jail for not less than one month, nor more
than six months, or both in the discretion 'of the
Court.

Misconduct
of Police to be
punished.

Sec. 5. Be it enacted. That the Mayor may when
he deems it proper and necessary appoint aspecial
police, which special police shall not act for more
than one day, and that any person resisting the
authority of the police, regular or special, shall
be subject to presentment and trial as though re-
sisting an authorized constable, and be subject to
the same penalties and punishments.

Special Po-
lice.

Sec. 6. Be it enacted, That before any such po-
lice, regular or special, shall enter upon the duties
of his office, he shall appear before the Mayor and
take and subscribe to the following oath : 1, —,
do swear, or affirm, in due form of law, that 1
will, to the best of my ability, discharge the du-
ties of police of Hagerstown, without fear, favor,
or partiality; which oath shall be preserved among
