site-party or his or their attorney on the record or
docket according to such rules as the said Com-
missioner may prescribe, and from any judgment
or order passed by said Commissioner under the
authority conferred by this Act either party may
appeal to the Judge of the Circuit Court for said
county within thirty days after the passing of such
order or judgment, and in all cases of appeal it
shall be the duty of the said Commissioner to cer-
tify to said judge a record of all proceedings and
evidence had before him in the matter, and an
appeal may be considered and determined by said
judge in or out of court, at his election and
according to such rules or practice as he may pre-
scribe.

Sec. 11. And be it enacted, That the judicial
records or the papers in any equity or judicial case
which was recorded or remained unrecorded at the
time of the fire, and which may have been wholly
or partially destroyed by fire shall be enquired
into and restored by the said Commissioner upon
proper evidence, in the same manner as prescribed
in relation to the restoration of other records and
papers and the finding and re-establishing of such
record paper or papers shall be certified by the
said Commissioner and ordered to be filed, recorded
or re-recorded anew as the case may be, and such
finding and recording shall secure to the parties
interested the same rights and titles in all respects
as if such record or papers had not been destroyed
or injured by fire.

Sec. 12. And be it enacted. That the recording
and other work authorized and required by this
Act for the purpose of restoring and re-establish-
ing such of the records, indexes, dockets and
papers in the office of the Clerk of the Circuit
Court for Baltimore County as have been either
wholly or partially destroyed by fire, may be done
by the Commissioner appointed by this Act or by
the Clerk of the Circuit Court for said county, as
the said Commissioner in his judgment and discre-
tion may order and direct, and the said Commis-
sioner shall have access to all the dockets, records,
indexes, papers and instruments of writing in the
office of the said Clerk, and the said Clerk is
hereby authorized and required to deliver to the
