the said Mahlon Davis, Joseph Ratcliff and Mau-
rice T. Starr shall hold their office of trustees for
two years, and that Dawson V. Hammond, Henry
Swope and Francis S. Jones shall hold their office
of trustees for three years, and until their succes-
sors shall be severally elected as hereinafter pro-
vided, and that in case of any vacancy that may
occur by death, removal, resignation or refusal to
act, of any of said trustees, the survivors shall
have the power to fill such vacancies. |

Sec. 5. And be it enacted. That the said trus-
tees shall be elected and the succession continued
in manner following, the male members of the
Methodist Protestant Church, over twenty-one
years of age, worshipping in Liberty Town in
Frederick county, and in regular standing in said
church, shall on the first Monday of May in each
year, upon due notice given from the pulpit, elect
the trustees to fill the places of such as shall have
served one, two or three years respectively, and
who have been appointed to fill a vacancy, the first
election to be held on the first Monday of May in.
the year eighteen hundred and sixty-eight, but the
failure to hold an election shall not affect the legal
existence of the corporation, and an election may
be held at any other period upon notice being
given as aforesaid, at a regular preaching appoint-
ment. |
