THOMAS SWANN, ESQUIRE, GOVERNOR. 143

SECTION 1. Be it enacted by the General Assem-
bly of Maryland, That John Shifler, A. Copen-
haver, Charles A. Gale, David Schlosser, John
Murdock, John B. Smith, John Nikerk and their
associates and successors in office, be and they are
hereby created a body politic and corporate, by the
name and style of the Boonsboro Cementery Asso-
ciation, and by that name shall have perpetual
succession) and shall be able and liable to sue and be
sued, in any Court of Law or Equity, may have
and use a common seal, and shall have power to
purchase and hold, not exceeding thirty acres of
land, with authority to said Corporation to receive
gifts and bequests for the purpose of ornamenting
and improving said Cementery, and to hold such
personal property as may be requisite to carry out
the objects of this Act; and the property now held
by said Association, shall vest in and belong to
this incorporation, and be subject to their control.

Sec. 2. Be it enacted, That the affairs of said
Corporation, shall be conducted by a President,
Secretary, Treasurer and a board of five Directors
to be elected annually, by a majority of the vote of
the proprietors, the said President and managers
to fill all vacancies in their own body; and shall
have power to lay out, sell or dispose of burial lots,
to appoint all necessary officers and agents, and
fix their several duties and compensation, and to
make such by-laws, rules and regulations as they
may deem proper for conducting the affairs of the
Corporation.

Sec. 3. Be it enacted, That all persons may be-
come members of this incorporation, upon such
terms as may be prescribed in the Constitution and
By-laws of said Association.
