ance.

clerks shall receive such compensation as the County
Commissioners may deem right and proper; and
for failure to perform the duty hereby imposed,
the said clerks to the said Commissioners shall for-
feit and pay a fine to the State of not less than five
hundred dollars, nor more than one thousand dol-
lars, in the discretion of the court, to be recovered
by indictment as for a misdemeanor, and the party
upon conviction, shall be committed to the county
jail, there to remain until said fine and all costs
accrued, shall be fully paid; and he shall be thence-
forth wholly incapable of holding or exercising
the duties of the said office of clerk to the County
Commissioners.

Duty of the
Judges of the
Circuit Courts.

Sec. 2. And be it further enacted, by the authority
aforesaid, That it shall be the duty of the Judges
of the Circuit courts for each of the counties of
Washington, Frederick and Carroll, within twenty
days of and not less than five days before the com-
mencement of the several terms of the courts of
said counties next succeeding the passage of this
Act, in the year one thousand eight hundred and
sixty-seven, and within the period of one month
of, and not less than twenty days before the com-
mencement of each and every term of said courts
thereafter, at which Juries are required to attend,
in the presence of such of the practising members
of the bar of said courts as she'll think proper to
attend, notice of the time and place having been
first given to said members of the Bar, through the
criers of said courts, to proceed to select from the
lists last furnished by the clerks of the County
Commissioners provided for in the first Section of
this Act, and from the poll-books of the several
Election Districts of said counties that shall be re-
turned to and filed in the Clerks office of said courts,
after any general election that may be last held
previous to such selection, a panel to consist of the
names of three hundred persons, to be fairly and
impartially selected by the said Judge with special
reference to the intelligence, sobriety and integrity
of such persons, and without the least reference to
their political opinions; and of the names of such
persons, when so selected, a list shall be made.
and a certificate thereto appended by the said
Judges, that said list of names has been duly se-
lected in conformity with, and according to the
