of any funds not otherwise appropriated in such
proportion as they may respectively appear by the
certificate of the Collector of Baltimore city to be
entitled to the same, a sum of money equal to the
amount of taxes paid by them in error into the
City Treasury on an excess of forty-eight thousand
two hundred dollars over assessment of the premi-
ses known as the Gilmor House of Baltimore city,
from the year eighteen hundred and fifty-eight to
the present time, and interest thereon from the
date of the respective payments of such excess. |

Sec. 2. And be it enacted, That the Treasurer of
the State of Maryland, be and he is hereby required
on the warrant of the Comptroller to pay to Wil-
liam Gilmor and Robert Gilmor, Junior, in the
proportion shewn to be due them respectively a
sum of money equal to the amount by them paid,
and received into the State Treasury in error on an
excess of forty-eight thousand two hundred dollars,
Over-assessment of said premises in the preceeding
Section named) since the year eighteen hundred
and fifty-eight. |

Sec. 3. And be it enacted, That this Act have

AN ACT entitled, "an Act to secure the comple-
tion of the Wicomico and Pocomoke Rail
Road." |

SECTION 1. Be it enacted by the General Assem-
bly of Maryland, That the lien held by the State
of Maryland, on the property of the Wicomico and
Pocomoke Railroad Company, to secure the pay-
ment of six per centum interest out of the profits
of the work on the shares of the capital stock of
the said Company, held by the State, shall not be
construed to give a preference to the said State over
the bond holders of the said Company, and the said |
Lien of the
State waived. |
