Deposition No. 61.

OWEN RIORDAN, being duly sworn deposed and said as fol-
lows, to wit:

By Mr. Devecmon:

1st Question. What is your name, age, residence and occu-
pation?

Answer. My name is Owen Riordan, age 40; live in Dis-
trict No. 4, Allegany county, Maryland, and am a miner
by occupation.

2d Question. When did you register as a legal voter ?

Answer. In September, 1865.

3d Question. Where was the election held November 6,
1866 in your District ?

Answer. It was held in an unusual place, in Powell's drink-
ing saloon, a cave under the mountain and about ten or fifteen
feet from the Railroad, and very close to the Potomac River.
Powell told me that he could not vote because he had a bet
made on the election.

[Note.—There being none of the contestees present, nor
their attorney, the witness was not cross-examined.

Deposition No. 62.

RICHARD J. WEST, being duly sworn deposed and said as
follows, to wit:

By Mr. Devecmon:

1st Question. What is your name, age, residence and oc-
cupation ?

Answer. My name is Richard J. West; age 33 years; re-
side in District No. 1, Allegany county, Maryland, and am
a farmer by occupation.

2d Question When did you register as a legal voter ?
Answer. In September, 1866, in District No 1.

3d Question. Did you attend the election held in your Dis-
trict November 6, 1866; did you offer to vote; was your vote
accepted or rejected, and whose names were on your ticket as
candidates for House of Delegates ?

Answer. I attended said election; offered to vote; but the
Judges refused my vote; the names on my ticket as candidates
for House of Delegates, were Wm. Devecmon, Wm. A. Bryden,
George W. McCulloh, John McElfish and Patrick Hammil.

RICHARD J. WEST.

Neither party desiring to make any further interrogatories
or producing any other witnesses, I accordingly close this
